Terms and Conditions
Effective November 5, 2026
These terms are an agreement between you and [legal operator name] ("we") for the Community Market apps and website (the "Service"). The app asks you to accept them and our Privacy Policy before you can use account features, and again if we make a change that needs your agreement. Using the Service also means you agree. If you don't agree, don't use the Service.
1. What Community Market is
Community Market helps neighbors find local stands, sales, pop-ups, classes and libraries, reserve items, and message hosts. We provide the platform. We aren't a buyer, seller, food producer, class instructor or agent of any user, and we aren't part of any sale. Sellers and hosts are independent and responsible for what they offer. We don't inspect goods or verify listings, identities or qualifications.
2. Who can use it
- You must be at least 13 to have an account. Accounts for anyone under 13 aren't allowed.
- You must be 18 or older to host a stand, sale or class, or to buy paid features. Teens may run a kid-run listing only under a parent or guardian's account, and that adult is responsible for it.
- If you're under 18, a parent or guardian should review these terms with you.
- The date of birth you give must be accurate. You can't use the Service if we've removed you from it.
3. Your account
You sign in with Apple or Google. Keep your account secure, keep your details accurate, and don't share, sell or transfer your account. You're responsible for what happens on it. You can delete it at any time in the app, as described in the Privacy Policy.
4. Buying, reservations and classes
- A reservation holds items for a limited time and isn't a payment. Buyers pay sellers directly, in person, unless the app clearly shows otherwise.
- Sellers can accept, decline or extend reservations. Holds that aren't picked up in time expire, and items go back on sale.
- Repeated no-shows can limit your ability to reserve.
- Pickup codes and check-ins record that a pickup or attendance happened. They don't prove payment.
- Refunds, returns, quality and disputes are between you and the seller. You can report a problem to us, but we can't guarantee an outcome.
- Check allergen and ingredient details with the seller before you eat anything. Homemade food may be prepared in a home kitchen that isn't inspected. Meet in safe places and use your judgment.
- Classes are run by their hosts. You accept the risks of taking part in any class, visit or pickup, to the extent the law allows.
5. Selling and hosting
If you list on the Service, you promise that:
- Your listings, photos, prices, stock, hours and locations are accurate and you have the right to use them.
- You follow all laws that apply to you, including cottage food, food safety, labeling, licensing, permits, zoning, consumer protection and taxes.
- Allergen and ingredient information you give is accurate and complete.
- You honor reservations you accept and answer buyers promptly.
- You use buyers' information only to complete their reservation or booking, and for nothing else.
- You don't list anything illegal, recalled, stolen, counterfeit or unsafe, or weapons, drugs, alcohol, tobacco, vaping products, live animals where prohibited, or adult items.
Listing a location shares it as you choose: exact or approximate. You're responsible for that choice. Taxes on your sales are your responsibility.
6. Community rules: zero tolerance
We have zero tolerance for objectionable content and abusive users. You must not post, send or do any of the following:
- Threats, harassment, bullying, stalking, hate or attacks on someone's identity
- Sexual content, nudity, or anything that sexualizes or endangers a child
- Violence, graphic content, or encouraging self-harm
- Illegal activity, scams, fraud, spam or fake listings, reviews or reservations
- Someone else's private information, or impersonating anyone
- Infringing other people's rights
- Attacking, scraping, reverse engineering or overloading the Service, or getting around blocks, limits or suspensions
Our servers check text before it's posted or sent and may refuse it. This first check covers text only. It won't catch everything and doesn't review photos, so reporting and staff review still matter.
7. Your content
You keep ownership of what you post, including listings, photos, reviews and messages. You give us a non-exclusive, worldwide, royalty-free license to host, store, copy, display and share it as needed to run, promote and protect the Service. This license ends when your content is removed, except for what we keep as the Privacy Policy describes. Reviews you wrote stay after you delete your account, shown as "Deleted user".
Staff may review content and messages for safety, support and legal reasons. See the Privacy Policy.
8. Reports, blocking and enforcement
You can report a listing or review in the app, and block the person behind it from the same menu. To report a message or anything else, contact us with the details using section 17. We review reports and aim to act on objectionable content within 24 hours, by removing it and removing the person responsible where warranted. Threats and child safety reports go first. In an emergency, call 911.
We may remove content, limit features, or suspend or end accounts if we believe someone broke these terms or put others at risk. We'll tell you the reason in the app where we can. Sellers can challenge a review, and you can ask us to look again at a decision by contacting us.
9. Paid features
Listing and buying are free today. In-app payments, Seller Pro and Boosts aren't offered at launch. If we offer them:
- The price, length and what you get will be shown in the app before you buy. You must be 18 or older.
- Purchases through the App Store are billed to your Apple account. Monthly and annual Seller Pro plans renew automatically unless you cancel at least 24 hours before the current period ends. You'll be charged for renewal within the 24 hours before it ends.
- A season pass doesn't renew. It ends on the date shown when you buy it.
- Manage or cancel subscriptions in your App Store account settings. Deleting the app or your account doesn't cancel one. Apple handles refunds.
- Any card payments and seller payouts would be handled by Stripe under its own terms.
10. License and our property
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app for your own lawful use. Apple device users may use it on Apple-branded products they own or control, as the App Store Terms allow, including through Family Sharing. The Service, its design, name and logo belong to us. Don't copy, sell, modify or reverse engineer them, except as the law allows.
11. Apple App Store terms
If you got the app from the App Store, these terms also apply:
- Agreement: this agreement is between you and us, not Apple. We, not Apple, are solely responsible for the app and its content.
- Scope: your license is limited as stated in section 10 and by the Usage Rules in the App Store Terms.
- Support: we alone provide maintenance and support. Apple has no obligation to do so.
- Warranty: we're responsible for any product warranty that can't be disclaimed by law. If the app fails to meet such a warranty, you may notify Apple and Apple will refund the purchase price, if any. To the fullest extent the law allows, Apple has no other warranty obligation for the app.
- Product claims: we, not Apple, handle claims about the app, including product liability, failure to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
- Intellectual property: if someone claims the app or your use of it infringes their rights, we, not Apple, are responsible for investigating, defending, settling and resolving that claim.
- Legal compliance: you represent that you aren't in a country under a U.S. Government embargo or designated as a "terrorist supporting" country, and that you aren't on any U.S. Government list of prohibited or restricted parties.
- Third-party terms: you must follow applicable third-party terms when you use the app, including those of your wireless provider.
- Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple may enforce them against you.
- Questions and complaints: see the contact details in section 17.
12. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the Service will be uninterrupted or error-free, or that listings, maps, hours, stock, allergen details or reviews are accurate. We aren't responsible for goods, food, classes, or what users do online or in person.
13. Limit of liability
To the fullest extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim is limited to the greater of $50 or what you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law, including for personal injury caused by our gross negligence or willful misconduct where the law doesn't allow that limit.
14. Indemnity
You agree to defend and hold us harmless from claims and costs that come from your content, your listings or sales, your use of the Service, or your breaking these terms or the law, to the extent the law allows.
15. Ending your use
You can stop using the Service and delete your account at any time. We can suspend or end your access as described in section 8, or stop offering the Service. Sections that by their nature should continue, such as 7 and 12 to 16, continue afterward.
16. Governing law
These terms are governed by the laws of the State of Idaho and of the United States, without regard to conflict of law rules. Disputes will be handled in the state or federal courts located in Idaho, unless the law where you live gives you a right to bring them there. Please contact us first so we can try to resolve the problem.
17. Changes and contact
We may update these terms. We'll post changes here and update the effective date, and we'll tell you in the app about significant changes. If you keep using the Service after they take effect, you accept them. If any part is found unenforceable, the rest still applies.
